Terms of Service

This document is not in force. It names no provider, because LEGAL_ENTITY_NAME, LEGAL_CONTACT_EMAIL, LEGAL_JURISDICTION are unset on the web service. Set them before anyone is asked to agree to this.

These terms are an agreement between you and [provider not configured] (“we”, “us”) covering your use of Mark (the “Service”). By signing in or subscribing you agree to them. If you don’t, don’t use the Service.

1. What the Service does

Mark is a marketing assistant you talk to in Telegram. It drafts social posts and blog articles, can generate images for them, schedules them, and publishes them to social accounts and websites you have connected. Drafting and generation use third-party AI models.

Nothing is published without your approval. The Service records an approval before anything goes out, and that approval is yours to give or withhold. You can pause proactive drafting at any time by telling Mark to stop.

2. Your account

Your account is your Telegram account. There is no password, no email login, and no secondary recovery method. This is deliberate, and it has a consequence you should weigh before subscribing: if you lose access to your Telegram account, you lose access to the Service and to everything in it. We cannot restore an account to someone who cannot sign in with the Telegram account that created it.

You must be at least 18, and you must be entitled to act for whatever brand or business you ask Mark to post as.

You keep ownership of everything you give us and everything Mark produces for you. You grant us permission to process and publish it only to run the Service on your behalf.

You are responsible for what gets published. You approve each post, so you are the publisher of it. AI-generated text and images can be wrong, misleading, or unintentionally similar to existing work — check them before approving. You must not use the Service to publish anything unlawful, deceptive, hateful, or infringing, to impersonate anyone, or to send spam.

Connected platforms (Facebook, Instagram, LinkedIn, your website, and others) have their own terms, and they can restrict, suspend, or remove your accounts and content for reasons that have nothing to do with us. We can’t override that, and we aren’t responsible for it.

5. Availability

We aim to keep the Service working but do not promise it will be uninterrupted or error-free. It depends on third parties — Telegram, AI providers, the publishing backend, the social platforms themselves — and any of them can fail or change. Scheduled posts can be delayed or rejected by a platform. The Service is provided “as is”, without warranties beyond those the law gives you and that cannot be excluded.

6. Liability

To the extent the law allows, our total liability to you for any claim relating to the Service is limited to what you paid us in the twelve months before the claim. We are not liable for lost profits, lost business, or indirect or consequential loss. Nothing here limits liability for fraud, death, personal injury, or anything else that cannot lawfully be limited — including your statutory rights as a consumer.

7. Ending it

You can cancel at any time, as described above. We may suspend or end your access if you breach these terms, if payment fails and is not resolved, or if we stop offering the Service — and if we stop offering it, we’ll refund any period you’ve paid for beyond the closure date. On termination we delete or anonymise your data as described in the Privacy Policy.

8. Changes

We may update these terms. If a change materially affects you, we’ll tell you before it applies to your next renewal. Continuing to use the Service after that means you accept it.

9. Law and contact

These terms are governed by the law of [jurisdiction not configured], and its courts have jurisdiction — without depriving you of any protection the mandatory law of your own country of residence gives you. Questions: [contact email not configured].
